One of the major problems facing the European Union is that of fraud committed to the detriment of the Union budget. Obviously, Romania's accession to the European Union also required the regulation of an adequate mechanism for the control and recovery of European funds, as well as of the national public funds related to them, used inappropriately, the Government of Romania adopting Emergency Ordinance no. 66/2011 on the prevention, detection and sanctioning of irregularities arising in the obtaining and use of European funds and/or of the national public funds related to them. Regarding this, a series of problems arose, both theoretical and practical, especially since its provisions are not found in another somewhat similar normative act, like the Government Emergency Ordinance no. 70/2022, on the prevention, verification and detection of irregularities/double financing, serious irregularities arising in the obtaining and use of non-reimbursable/reimbursable external funds allocated to Romania through the Recovery and Resilience Mechanism and/or of the national public funds related to them and the recovery of resulting receivables.
